Terms of Service

• "Service" means the MyGymPanel web application, APIs, and any related software or content we provide.
• "Owner" means a user who creates and operates a gym workspace on the Service.
• "Member" means a user who joins a gym workspace as a customer of an Owner.
• "Content" means anything uploaded, posted, or generated through the Service — including profiles, photos, plans, messages, and member data.
• "You" / "your" means the individual or entity using the Service.

You must be at least 16 years old to create an account. If you're under the age of majority in your jurisdiction, you confirm you have permission from a parent or legal guardian. Owners enrolling minors as Members are responsible for obtaining verifiable parental consent before adding their data.

You may not use the Service if we have previously terminated your account, or if you are barred from using it under applicable law.

• You're responsible for keeping your login credentials secret.
• You're responsible for everything that happens under your account.
• Notify us immediately if you suspect unauthorised access.
• We may require additional verification for high-risk actions (e.g. account deletion, billing changes).

One person or legal entity per account. Sharing a single account across multiple owners is not permitted — each owner should have their own login.

MyGymPanel is a tool you use to run your gym. The relationship between an Owner and their Members (including any membership contract, refund policy, attendance rules, training services, or fees) is solely between the Owner and the Member.

• Owners are the controllers of their Members' personal data. We process it on the Owner's behalf.
• Owners are responsible for the accuracy, lawfulness, and consent for any Member data they upload.
• Members can leave a gym at any time from their member dashboard. Their personal account remains with us until they delete it.
• Disputes between Owners and Members (e.g. refunds, fitness outcomes, conduct) are not our responsibility, although we may suspend accounts that violate these Terms.

You agree not to:

• Use the Service for anything illegal, fraudulent, or harmful.
• Upload viruses, malware, or any code designed to disrupt the Service.
• Attempt to reverse-engineer, decompile, or extract source code from the Service, except as expressly permitted by law.
• Bypass rate limits, security controls, or access mechanisms.
• Scrape, harvest, or otherwise extract data from the Service in bulk without our written consent.
• Use the Service to send unsolicited marketing (spam), harass other users, or post hateful, defamatory, sexually explicit, or otherwise abusive content.
• Impersonate any person or misrepresent your affiliation with any person or entity.
• Use the Service to compete with us by building a substantially similar product.

We may, at our sole discretion, remove Content, suspend, or terminate accounts that we reasonably believe violate this section — with or without prior notice depending on the severity.

You retain all ownership rights to the Content you upload. By uploading Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and process that Content solely to operate, maintain, and improve the Service for you. This licence ends when you delete the Content or your account (subject to the retention rules in our Data & Storage Policy).

You are solely responsible for your Content and confirm you have all rights and consents necessary to upload it.

The Service, including its software, design, logos, trademarks, and documentation, is owned by Creovate Technologies (operated by Abhinav K and Ajay KM, founders; private limited registration pending) and protected by Indian and international intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose, subject to these Terms. No other rights are granted.

The Service is currently provided in early access. Pricing for paid plans, when introduced, will be displayed in-app and require your explicit acceptance before any charge.

• When payments go live, we will integrate Razorpay as our payment processor. Card / UPI / netbanking data is handled by Razorpay under their own terms and privacy policy.
• All fees are exclusive of GST and other applicable taxes unless stated otherwise.
• Subscriptions renew automatically unless cancelled before the next billing cycle.
• Refunds are handled case-by-case and per the refund terms presented at checkout.
• Invoices and receipts are available in your billing dashboard and via CSV export.

We may label certain features as "beta", "preview", or "experimental". These are provided as-is, may change or disappear without notice, and may not work as documented. Use of these features is at your own risk.

• You may delete your account at any time from Settings → Danger zone.
• We may suspend or terminate your account for violation of these Terms, suspicious activity, or to protect the Service and other users.
• We will give you reasonable notice unless doing so would harm the Service, another user, or our legitimate interests.
• On termination, your right to use the Service ends immediately. Sections that by their nature should survive (IP, disclaimers, limitation of liability, governing law) will survive.

The service is provided "as is" and "as available".

To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.

MyGymPanel is a software tool. It is not medical, fitness, nutritional, financial, or legal advice. Any workout plans, diet plans, or wellness suggestions surfaced through the Service are informational only and should not replace advice from qualified professionals. Owners and Members use such information at their own risk.

To the maximum extent permitted by law, in no event will Creovate Technologies (operated by Abhinav K and Ajay KM, founders; private limited registration pending), its founders, employees, or affiliates be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business opportunity.
• Injury, death, or harm resulting from use of fitness or dietary information surfaced through the Service.
• Acts or omissions of any Owner, Member, or third party using the Service.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, or (b) INR 5,000. Some jurisdictions don't allow these limits — in that case, the limits apply to the maximum extent permitted by law.

You agree to indemnify and hold harmless Creovate Technologies (operated by Abhinav K and Ajay KM, founders; private limited registration pending) and its founders from any claim, loss, liability, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) your Content. We may take exclusive control of any matter for which you owe us indemnification, at your expense.

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

Before filing a formal claim, you agree to first contact us at support@mygympanel.com and attempt to resolve the issue informally for at least 30 days. Nothing in this section limits your statutory consumer rights.

We may update these Terms as the Service evolves. Material changes will be announced in-app and by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance. If you don't agree to the new Terms, you must stop using the Service and may delete your account.

• Entire agreement. These Terms, together with our Privacy Policy and Data & Storage Policy, are the entire agreement between you and us regarding the Service.
• Severability. If any provision is found unenforceable, the rest will remain in effect.
• No waiver. Our failure to enforce any right is not a waiver of that right.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Notices. We may send notices to you by email or via the Service. You may send notices to us at the email below.
• Force majeure. Neither party is liable for delays caused by events beyond reasonable control.
